Things that shouldn’t EVER need to be said about the United States of America:
it just should not be possible for our government to kidnap someone, ship him off to Syria knowing that he will be tortured, and then have no one be in any way accountable.
But yet, thanks to George Bush and his fearful and fear mongering administration, we do actually need to stand up and say that. It’s a travesty.
The article is about the fact that the Second Circuit decided to rehear the Maher Arar’s case against the government with the full panel of judges without either side filing papers for this to happen. They decided on their own that the 3-judge panel that originally ruled on the appeal wasn’t adequate and they wanted the full court to hear the case.
I’m no legal scholar, but, you know, I do pay attention to this stuff and I can’t remember hearing about a Circuit Court doing something like this. Any of the real lawyers know anything more?
